La evolución del artículo 122 TFUE: hacia una capacidad fiscal europea

Resumen
El presente estudio examina cómo los fondos Next Generation EU (NGUE) han supuesto un precedente en la transformación del marco constitucional fiscal de la Unión Europea, a partir de una reinterpretación del apartado primero del artículo 122 del TFUE. En primer lugar, se analiza la arquitectura jurídica de los NGUE y los cambios que introduce en el marco de la gobernanza económica de la Unión. El análisis incorpora la evolución histórica y la interpretación jurisprudencial del artículo 122 TFUE, a partir de lo cual se sostiene una lectura evolutiva del primer apartado de dicha disposición como fundamento implícito para el desarrollo de una capacidad fiscal propia de la Unión, sin necesidad de una reforma formal de los Tratados.
